AGB – General Terms and Conditions of Stefanie Bubenzer Performance Horses

1. subject matter of the contract

These GTC apply between Stefanie Bubenzer Performance Horses (hereinafter referred to as the Organizer)
and the Customer (hereinafter referred to as the Participant) for all contracts concluded,
in particular for participation in courses at Paasbachhof and lessons
(hereinafter referred to as the Event). – External courses: see separate GTC. The contractual services and participation requirements are set out in the respective
advertisements of the organizer. The services are provided exclusively in accordance with the terms and conditions of
.

Any deviating terms and conditions of the customer are hereby rejected.

2. conclusion of contract Events

The basis of the organizer’s offer and the participant’s booking is the
respective course description and the supplementary information, or in the case of special arrangements
the individually prepared offer of the organizer. The registration / booking is made in writing by e-mail or online form. The following applies: With the booking, the participant makes a binding offer to the organizer to conclude the contract.
The contract is concluded upon receipt of the booking confirmation by the organizer.

3. conclusion of contract Lessons

The offer is based on the currently valid price list. The booking is made in writing via
mobile message, e-mail or online form. The contract is concluded with the booking confirmation
of the organizer.

4. payment

The full event fee must be paid in cash on the first day of the event before the start of the event
, or in advance by bank transfer to the organizer’s
account by a date specified by the organizer, on request against an invoice.

5. prices and services

The prices are based on the respective event announcement of the organizer,
, which is published on the organizer’s homepage www.stefanie-bubenzer.de
. The prices do not include the cost of accommodation and meals for the participant
and any horse brought by the participant, unless expressly stated otherwise in the advertisement
. If a rental horse is booked, the provision of the necessary equipment for the horse is included in the
course price. The provision of the equipment required for the event
(e.g. poles, pylons etc.) is included in the event price.

6. withdrawal of the participant / cancellation fees

6.1 Withdrawal from mobile lessons

The contract is deemed to have been concluded as soon as the participant has given written confirmation.
From this point onwards, it is no longer possible for the participant to withdraw and the entire
tuition costs including the travel fee will be charged. The participant has the option of finding a replacement at
independently.

6.2 Withdrawal from lessons at Paasbachhof or online

The contract is deemed to have been concluded as soon as the participant has given written confirmation.

Cancellations less than 48 hours before the appointment: the full tuition fee excluding the
facility usage fee is due. Cancellations less than 48 hours to 7 days before the date: 50% of the tuition fee
excluding the facility usage fee is due. The participant can arrange a replacement independently.

6.3 Withdrawal from courses at the Paasbachhof

The contract is deemed to have been concluded as soon as the participant has given written confirmation.
From this point onwards, it is no longer possible for the participant to withdraw. The participant can
independently arrange for a replacement. If there is a waiting list for the course, the organizer can assist in the search for a
replacement participant. If a replacement is found, the course costs will be refunded less
20 € processing fee. If a substitute participant joins the contract, he/she and the participant are jointly and severally liable to the organizer
for the price and any additional costs incurred as a result of the substitute participant joining
.

7. cancellation of the event by the organizer

If the event has to be canceled due to e.g. illness of the organizer,
the costs will be refunded in full.

8. exclusion from the events

The participant may be excluded from the event without reimbursement of any costs if:

  • In the event of a breach of the Animal Welfare Act or other applicable law.
  • In the event of violation of the applicable court regulations of the venues.

9 Liability provisions

The organizer and his rental horses are covered by liability insurance. There is no special accident insurance for participants
. Accident insurance is recommended for every participant. The participant is solely liable for any damage caused by the participant or his horse during the
event. These liability provisions
also apply to indirectly injured parties to whom the participant is obligated. Participation is at the participant’s own risk. The organizer excludes liability for all
personal injury, property damage and financial loss caused to the
participant by slight negligence on the part of the organizer or his agents, insofar as these are not covered by liability insurance
of the organizer. All young riders up to the age of 18 must wear a suitable protective helmet in accordance with the valid European standard and sturdy footwear at events where riding takes place

legal guardians are not released from their supervisory and liability obligations. Adult riders are strongly recommended to wear a riding helmet and suitable clothing (in particular
the wearing of safety shoes for ground work). If
adult participants decide to take part despite wearing unsuitable shoes and/or without a riding helmet,
they do so at their own risk.

10. regulations for the participation of horses

Horses brought to the event by the participant must have up-to-date vaccinations
, the scope of which is determined by the venue. The equine passport must be presented at the request of the organizer
or his assistants. Vaccination
against influenza is compulsory at Paasbachhof and must not be older than 9 months. Horses brought to the event by the participant must be free of infectious diseases
and come from disease-free stock. At the request of the organizer, a veterinary certificate must be submitted to
before the start of the event. Horses brought to the event by the participant must have valid liability insurance
which includes the risk of working with unusual bridles.
Proof of this must be presented at the request of the organizer or his assistants.

11. exclusion of claims and statute of limitations

The participant must assert claims for non-contractual provision of the booked service within one month of the contractually agreed end of the event.
